What makes a good mediator?
I was travelling across the country last week and encountered people who wanted to know what makes a good mediator. At best, it is trust, confidence and rapport. These three things take up very little space in print but make all the difference during settlement meetings in conference rooms occupied by people who want a dignified, respectful process. Often we forget to quantify the value of a respectful negotiation and a dignified exchange of ideas. These are commodities that don't get included in a written and enforceable settlement agreement but they make all the difference to the resolution of a case.
